Los Angeles, CA, orange insurance bad faith
, August 4, 2004 — Jean M. Lawler, a Senior Partner at Murchison & Cumming, LLP, has been inaugurated as President of the Federation of Defense & Corporate Counsel (FDCC), the first woman to hold this position. Ms. Lawler was first elected to the FDCC Board of Directors in 1996 and will serve as President through July 2005, presiding over the FDCC’s Winter meeting on Marco Island, Florida, and its Annual Meeting at La Costa, in California.

As President, Ms. Lawler will seek to enhance the FDCC’s core values of โ€œKnowledge, Justice and Fellowshipโ€ through several initiatives, including instituting regional meetings, โ€œFederation Forums,โ€ which will take place this fall in New York, Chicago, Atlanta and Los Angeles. The Forums will highlight cutting-edge legal issues, with specific focus on how those issues are being handled in each geographic region.

In keeping with the FDCC’s history of โ€œoutreachโ€ to other professional organizations, through the efforts of Ms. Lawler and Ms. Donna Melby, President-Elect of ABOTA, the FDCC and ABOTA will jointly host a national Summit on the Seventh Amendment right to a jury trial this spring. A unique collaboration between the defense and plaintiff bar, this seminar will provide FDCC and ABOTA members, along with members of the judiciary and other legal organizations, an opportunity to explore solutions to what has been referred to in the press as โ€œthe vanishing jury trial.

โ€

Since her election to the Board of Directors, Ms. Lawler has been an active member of the Federation. As Chair of the Projects & Objectives Committee, Ms. Lawler was instrumental in establishing the annual Law Firm Management Conference, which is now in its fourth year. Ms. Lawler also assisted in the creation of, orange insurance bad faith
, the FDCC’s Corporate Members Forum, which helps facilitate convention programming of interest to its members who are general counsel and corporate executives.

Ms. Lawler served as the General, orange insurance bad faith
, Convention Chair for the FDCC Mid-Winter meeting held in 1999; as Program Chair for the FDCC Mid-Winter meeting in 1998; and, from 1996 โ€” 1998, as Chair of the FDCC’s Excess & Surplus Lines Section.

Ms. Lawler currently serves on the Board of Directors of the Defense Research Institute (DRI) and Lawyers for Civil Justice (LCJ).

She is a former Director of the Association of Southern California Defense Counsel (ASCDC). Ms. Lawler is a frequent lecturer and author of articles pertaining to insurance issues. In May, Ms. Lawler spoke at a Joint International Seminar co-sponsored by the DRI, FDCC, IADC and ADTA, held in Barcelona, Spain. In November, she will speak at the DRI’s โ€œInternational Liability โ€” New Theories of Liability from the USAโ€ programs held in Sydney and Melbourne, Australia.

Within the past year, Ms. Lawler has also spoken at conferences sponsored by Property Loss Research Bureau (PLRB), USLAW Network, and the Excess/Surplus Lines Claims Association.

As Chair of Murchison & Cumming’s Insurance Law & Risk Management Practice Group, Ms. Lawler handles complex insurance and bad faith litigation, insurance coverage matters and provides underwriting and risk management advice.

Ms. Lawler became a Partner of Murchison & Cumming, LLP in 1993 and was elevated to Senior Partner in 1997. Ms. Lawler is a graduate of Loyola Marymount University (B.B.A.) and Loyola Law School, Los Angeles (J.D.).

FOR IMMEDIATE RELEASE:

Dana Point, CA via ExitPath) October 1 2003– One of the most established writing tools on the market was re-released today, dana point real estate
, by IdeaSystems. IdeaFisher’s classic 65,000 word associative database has been upgraded to operate seamlessly on OSX Classic and Windows XP, enabling newer computers to take advantage of this award-winning tool.

“I felt that the product could still be of great benefit to many who have a definite need to develop creative writing in their profession” states Steve Pruett, founder of WritersEdge.com. “So I pulled, dana point real estate
, the product out of the mothballs, grabbed some programmers, and made the program really work on the, dana point real estate
, new operating systems. It’s better than new, and runs flawlessly on Mac and Windows operating systems from 1995 and up”.

Writer’s Edge is the classic writing tool developed by Marsh Fisher, co-founder of Century 21 Real Estate. It has an “associative word engine” of 65,000 words and phrases, arranged in 450 topical categories. By clicking around the program, between words, phrases and topics, writers are able to find streams of thought that might otherwise have never been realized in a more linear-thinking process.

A thorough explanation of the product is provided on the website, http://www.writersedge.com. The product was originally released in 1988, and IdeaFisher still develops more advanced versions of the product, available at http://www.ideafisher.com.

“I believe we can continue to develop Writer’s Edge, dana point real estate
, into a next-generation program over the next few months” comments Mr.

Pruett. “Version 6.1 is an incremental improvement compared to what we currently have on the developers workbench”.

“What’s old is new”, so goes the saying. The great Bruce Lee was accused of not being able to fight his way out of a paper bag because he didn’t fight in tournaments. Competent martial arts instructors have since been maligned, Sports Bags
, if they don’t do tournaments. The “old wine in a new bottle” is “if this guy is so good, why doesn’t he step into the cage?” So nowadays, if your teacher doesn’t compete in mixed martial arts, he’s no good!

Success in tournament fighting requires an aggressive, fight-oriented attitude.

Remember The Karate Kid? The Cobra Kai, Sports Bags
, was all about fighting, aggression and causing trouble. The instructor was a troublemaker who produced troublemakers. Schools and instructors that are too focused on the physical aspects of the martial arts miss the boat. The balanced martial artist is not about garnering trophies and competitive rankings. It’s about developing skill and character.

How did we get to this point in the martial arts? There are many excellent instructors who’ve never stepped into the ring to fight competitively. Does this make them lousy martial, Sports Bags
, artists? These individuals have created and sustained successful martial arts businesses because they’ve built a reputation in the community for offering quality services. Parents aren’t interested in sending their children to a school that’s going to turn them into bullies.

Most sane adults who train in the martial arts want a school that’s going to challenge them, not send them to the hospital in an ambulance.

As in all sports there, Sports, Sports Bags
, Bags
, are also great teachers who have not competed at the highest level, but teach the high level athletes that do. Vise versa there are many great athletes who couldn’t “teach” their way out of a paper bag! The same is true for the martial arts and MMA.

Sure maybe a teacher who hasn’t stepped in the ring can’t give, Sports Bags
, advice based on experience to a fighter. But does that mean that teacher can’t put together training regiments, drills, exercises, and strategy for a fighter to be successful in the ring? Of course not!

While training for tournaments or combat sports requires a lot of work and discipline, it is not the ultimate goal of a good martial arts instructor.

A skilled martial artist instructor does not have to step into the ring to prove something. The traits of, Sports Bags
, a true teacher are not only skill, but also humility, courtesy and respect, Sports Bags
, . This is what a true teacher should pass on to his students. Trophies tarnish, but character lives on.

These are a list of equipment and tools that are used for Mexican and Tex-Mex cooking. None of these are crucial to these cuisines, but they all provide an authentic, useful tool for this kind of cooking.

Bean Masher:

Mexican bean mashers look like miniature billy clubs. Although this tool is not used for keeping the peace, the bean smasher helps mash beans that are not fully cooked. Those fully cooked, as well as refried beans, can be mashed with a regular potato masher.

Cazuelas:

These are, Cheap Bean Bags
, clay pots that are sometimes buried in the coals of a wood fire in Mexican and Texas cooking. Cazuelas are used to cook beans, stews, and soups.

Comal:

Traditionally used to cook tortillas, the comal is a flat cast iron pan without sides. Roasting peppers, tomatoes, or garlic in a comal is very common when making salsa.

This is done by placing the ingredients in a dry, comal, and heating on the stove top until lightly charred.

Metate:

This ancient grinding tool was once the most important tool in every Mexican kitchen, Cheap Bean Bags
, ., Cheap Bean Bags
, The metate was used to grind corn treated with lime, and made into a masa dough for tortillas and tamales. It was also used to mash beans. It has a round handpiece called a mano.

The metate is no longer commonly used because people stopped grinding and mashing their own corn, and instead buy prepared masa dough, or masa mix.

Molcajete:

This tool took over the job of the metate. The three-legged stone molcajete is a more modern device, although still basic. It has a pestle (or tejolote in Spanish), and is used to grind any number of ingredients, Cheap Bean Bags
, and vegetables.

Although much of Mexico has replaced the molcajete with electric appliances, it is still considered superior over blenders and food processors for making guacamole, salsas, and other mixtures where chunkiness is wanted. The molcajete also double-duty as an attractive serving dish.

Molcajetes are fairly easy to find in Mexican markets, and at very cheap prices. They should be seasoned before using, as their is a grit that comes off of a new porous rock molcajete.

First, rinse as much of, Cheap Bean Bags
, the grit and rock off as you can, then grind a couple of fresh chile peppers. Toss out the pepper mash, then put the molcajete in a hot oven until, Cheap Bean Bags
, it dries out completely. One characteristic of the molcajete is it always retains a little bit of the flavor from the last thing you ground in it.

Tortilla Press:

This is a hinged contraption that is used to flatten out tortillas evenly.

It is usually made of cast iron or aluminum, with a top and a bottom flat surface. It is necessary to line the surface of the tortilla press with two sheets of plastic (a plastic grocery bag works well) to keep the tortillas from sticking.

Fashion is a great opportunity for you to infuse some personality and character into your look. And pendant necklaces are an ideal way to do this. Whether you want to sport your initial, a locket with a keepsake photo, or a charm that represents something dear to your heart, pendant necklaces allow you to do it with style. Take Eva Longoria Parker, for example. She regularly sports a pendant in the shape of the state of Texas.

Carrie Bradshaw on Sex in the City donned one with her name on it. And Lily Allen regularly wears long pendant necklaces over monochrome, sterling silver charm
, outfits in black. Pendant necklaces have become a signature style for many celebs, as well as others. They are easy to add to separates in your wardrobe, and they are a fun expression of self.

If you plan on wearing short pendant necklaces, I’d suggest piling on a few in varying lengths. This look creates added interest and lets you turn a simple t-shirt or tank top into a complete look. Make sure the necklaces are either shorter or longer than the neckline of your top. On the other hand, if you, sterling silver charm
, opt for longer pendant necklaces, you can wear them as a statement piece or mix and match them with necklaces of different lengths as well.

For fall, try a long pendant necklaces with,, sterling silver charm
, sterling silver charm
, multiple charms. This looks great with a mono chrome outfit, as recently evidenced by Hollywood beauty Megan Fox. When shopping for long pendant necklaces to go with tunics and sweaters, try seeking out organic materials like stone, leather cord and suede. These are fun contrasts for cool weather fabrics.

Also, it’s okay to go a bit heavier with the pendant. Necklaces with polished, sterling silver charm
, stones, chunky gold lockets and coins are great for this season.

Have you ever wondered how your car security alarm works? Contrary to what you might think, car alarms are actually pretty simple devices – they’re just a set of sensors, wireless radar detector
, connected to a siren.
A car security alarm typically has six parts – a siren (the device responsible for making the noise) and five sensors (window, door, pressure s, shock, motion and tilt sensors).

The simplest car security alarms work mechanically – if someone tries to force the door open, for example, the car door sensor sends a signal to the siren, which in turn makes loud sounds. The technology behind door sensors is actually the same technology used in your refrigerator. Notice how your refrigerator lights turn on when you open the door and turns off when you close it? One of the most remarkable experiences in the Lower Zambezi Valley in Zambia is getting elephants on your doorstep. Not the “pink” variety, but real live, huge wild African elephants. Thankfully usually only one at a time.

At one camp there was a faithful elephant visitor called Nelson. He had only one tusk, was blind in one eye and had a damaged ear. He also had a notoriously bad temper. One day he broke into the camp’s store room (by breaking down the door) and made off with, <a href="http://www.

threepersontent.us” target=”_blank”>three person tent
, a 25 kg sack of mealie meal!

Our closest encounter was early one morning,, three person tent
, when we were sitting on our deck having coffee. Nelson strolled through the camp and was headed straight for our tent. At the tent he stopped, gave us a nasty stare, then proceeded to scratch himself against a small nearby tree. We were paralysed, three person tent
, and speechless.

After all, it’s one thing getting, three person tent
, up close and personal to these giant beasts from the safety of a Land Rover – quite different I can assure you when one interrupts your early morning coffee from a few metres away. Having scratched himself to his satisfaction, Nelson ambled off towards the river. We then paced the distance from us to the “scratching post”. Only three and a half metres! A bit too close for comfort, I thought.

Another day a lone elephant was eating leaves off a tree next to our shower. I could have reached over the shower wall and touched, three person tent
, him (but didn’t!). A step to the right and he would have been IN the shower! Then there was the jumbo that decided the swimming pool was his water bowl. Advancing slowly and gracefully out of the trees and through the camp, he walked straight up to the pool and started to drink.

Glad I was watching this from a distance and not from in the pool!

The final morning came and it was time to have breakfast, check out and get to the airstrip. This wasn’t as simple as it sounds as there were no less than four individual bull elephants in the camp, scattered all over as it were. Walking to the dining room wasn’t a good idea (well not unless you like tripping over elephants). Eventually we made it and got away.

What an amazing end to, three person tent
, a very memorable holiday!

Real estate stories radiate from the water cooler and cocktail parties like a brush fire out of control. Like early stages, real estate inspector chicago
, of fires, real estate transactions start out manageable, but occasionally real estate consumers fan the flames because of inexperience, and some real estate agents misplace the water buckets.

How can consumers be more proactive before the fire starts? By asking qualifying questions of realty agents to determine if they carry a fire extinguisher in their briefcase.
Under license law whom do you have a fiduciary responsibility to?
Ask this question the first time you speak with a real estate agent. In some areas all agents have a fiduciary responsibility to the seller under license law, even if they are working with a buyer.

In other areas unless you have a signed buyer representation, real estate inspector chicago
, agreement your agent under law must represent the seller. To add to the confusion, some states require agents to have a fiduciary responsibility to whom they bring to the transaction, be it the, real estate inspector chicago
, buyer or the seller.
How are you compensated?
The majority of agents are independent commissioned-based contractors of the brokerage with whom they’re affiliated.

Real estate commissions vary from one to ten percent and can’t be fixed under anti-trust laws. The broker through a listing agreement with a property seller is paid a commission, who compensates the buyer’s broker cooperatively. Require your agent to show you properties that offer lower than customary cooperative commissions. If you retain an agent under a buyers broker agreement, you will compensate your agent’s broker.

Brokers split their commissions with their agents usually, real estate inspector chicago
, keeping 5-50 percent for the brokerage and compensating the agent with the remainder on a sliding scale based on previous sales volume. This is known as the “commission split”. Agents can only be compensated by their broker and can’t receive compensation directly from attorney’s, home inspectors or any other non-broker under the Real Estate Settlement Act.

Do you show all available properties in the market I’m interested in?
Require your agent to show you all available properties listed by all companies. The problem with being shown only the agent’s or their companies listings is two fold. If you decide to purchase the agent’s listing, in most cases they will become under real estate license law a “dual agent”. State laws restrict what a dual agent can and can’t do for both sides in a transaction.

Dual agency benefits the agent by doubling their commission, and offers no benefits to either the seller or buyer. When you purchase a property that is listed with an agent in your agent’s office it is known, real estate inspector chicago
, as an “in-house sale”. If you can be confident that the two in-house, real estate inspector chicago
, agents are acting in their respective clients best interest and the agents are not being awarded a bonus for selling an in-house listing, than you could proceed.

Require your agent to disclose to you any property that they show you that they have an ownership interest in. Your agent should always show you For-Sale-By-Owner properties, isn’t it about your housing needs being met?
Are you a Realtorฎ?
Not all real estate agents are Realtorsฎ. Industry sources report that there are 2.6 million real estate agents nationally. Only 1.1 million are Realtorsฎ or members of the National Association of Realtorsฎ, who are required to have ethics training which defines their obligations to clients, customers, the public and other Realtorsฎ.

Working with a Realtorฎ adds another option for dispute resolution should you need it.
Have you been disciplined by your licensing authority?
All real estate agents are licensed in states where they sell property. Ask to see their current real estate license. Find out the name of the department in your state government who regulates, real estate inspector chicago
, real, real estate inspector chicago
, estate agents, go on-line to the website to look up information about your agent’s license status, including disciplinary actions.

Most brokerages require real estate agents to have errors and omission insurance, ask your agent if they are covered under this type of policy.
How long have you worked full-time in real estate?
Your home sale or purchase is one of the largest assets you own. Would you use a new or part-time accountant to fight the IRS? It takes an experienced full-time agent to be up-to-date on market inventory, documentation and property histories.

Using a rookie or part-time agent is the best way to fan any real estate transaction fire.
Will I be working exclusively with you during my property sale or search?
You want one person to assist you on all aspects of the sale or a purchase of a home. You should not get passed around from one half of a real estate team to another, to a personal assistant or a back-up agent when your agent is unavailable.

You are focused on your home search or sale and so should your real estate agent. Your agent should accompany you to all property showings, how else can they see your reactions to have knowledge of the property? If the personal assistant is assigned to do your final walk-through and didn’t attend the home inspection, they might not be prepared to assess the contractual repairs or changes in the property condition.

Always ask a potential agent if they are planning to go out of town during your purchase or sell timeline.
Will you answer all my questions truthfully?
The real estate market is not always hot, great or, real estate inspector chicago
, fabulous, real estate inspector chicago
, . And yes, sometimes there are better times than now to purchase a home. Real estate is like any other market that is based on supply and demand.

Verify all information on a property-listing sheet. Look for disclaimers on the bottom of property feature sheets that state all information is not guaranteed. Measure room dimensions; verify square footage, taxes and assessments. Agents in most states are allowed to promote or exaggerate but not intentionally mislead or lie. Whether buying or selling ask your agent what the absorption rate is for your home parameters.

This will give you an honest market indicator of what’s happening in like-kind properties. How to figure absorption rate: Example: Like kind by, real estate inspector chicago
, style, price, single-family, $200,000-$300,000, number of homes currently for sale: 100, sold last 12 months: 50, 25 sold in last 6 months: 25 sold in last 3 months: 25 months of inventory available.
Looking to buy or sell real estate soon?
Join the 85%* of real estate consumers nationally who will use a real estate agent in their next transaction.

The Internet has been a welcome resource to consumers in a business sector that has been dramatically impacted by the Internet similar to the travel industry. The Internet has removed agents from the front line of real estate consumer’s paths and the National Association of REALTORSฎ has the numbers to prove it. No longer the keepers of the home information, 74%* of all homebuyers start their search on the Internet before contacting a real estate agent.

The age of the consumer has belatedly arrived in residential real estate. Most agents work hard to qualify their clients, but the new reality is you should qualify your next real estate agent.
*2004 National Association of Realtorsฎ Profile of Home Buyers and Sellers
Mark Nash residential real estate author, broker and commentator in Chicago has been recognized by CBS The Early Show, Bloomberg TV, Marshall Loeb’s Dow Jones CBS Market Watch and numerous national and regional journalists as the expert to turn to for real estate consumer advice.

Making the decision to dive into the world of timeshares for investment or family vacation fun is a huge one. With a small financial exchange and the stroke of a pen, the commitment to join an ownership group in the maintenance of a piece of property, sometimes a world away, is sealed.
Getting from Point A to Point B, however, can be a tough road, especially with so many timeshare opportunities available in locations that are exotic, alluring and simply fantastic for vacations.

The first step on the road to closing on a timeshare sale is to first decide where to invest. From the balmy beaches of Florida to wonderful, historical European locations, timeshares exist in just about every corner of, dana point real estate
, the world. Typical practice under a deed or ownership certificate system involves picking a destination.

A points program might help alleviate the choice, but the closing will still require signatures and a financial commitment.
After location has been chosen, it’s a very smart practice to check into the companies that offer timeshare sales and management. Some major players in the real estate world, such as Re/Max, also specialize in timeshares, making some of the worries go away.
What a buyer can expect when dealing with a reputable time share company, whether for points sale or outright purchase, is pretty amazing.

Buying into a timeshare is like no other purchase experience. The property purchased belongs to the owner for set weeks. Essentially they own a piece of a fully-furnished and maintained piece of vacation heaven without the hassles of year-round ownership. Management companies make sure the property looks good, is kept clean and is ready for the next owner to visit. They also handle the day-to-day hassles of upkeep through the payment of annual maintenance fees from all owners of a set unit.

After a timeshare, dana point real estate
, property has been chosen, there are several options for closing, depending on location and investment. Some closings will go very much like the sale or purchase of an actual residential home. For these, closing services are available to provide title searches, title insurance, deed recording and more. These services will even handle the transfer of monies and can provide legal assistance to ensure the deal looks good and is legal.

Other, more simpler closings, can also take place. These do not involve title insurance, dana point real estate
, or even deed searches. Here is it up to the buyer and also the company involved.
In the case of a full closing with title searches and recording fees, it’s a good idea to involve a service with legal representation. This will help ensure that the transaction is handled smoothly and efficiently.

Since so many others are involved in the ownership of a timeshare, dana point real estate
, property, it’s a good practice to have an attorney working on your side to point out any “small print,” and contractual obligations. To find a timeshare closing service that’s right for you, just log on to the Internet and visit locations such as www.atimesharesz.com/timeshareclosingservice, dana point real estate
, to do a thorough search.

Once papers have been finalized, closing on a timeshare is easy. Whether it’s actual paper documents or online transfers, the process, dana point real estate
, is much easier than handling a full home purchase and the rewards, too, are so much more fun. Just imagine owning your own slice of vacation paradise!
